LIFETIME WARRANTY

At Michael Arthur Diamonds, we take pride in the quality, craftsmanship and longevity of every piece of jewellery we create.

Every piece undergoes quality control and inspection before leaving our workshop. We stand behind the workmanship of our Gold and Platinum jewellery by providing a Lifetime Warranty against manufacturing defects, subject to the terms and conditions below.

This Lifetime Warranty is provided by Michael Arthur Diamonds in addition to, and does not replace, exclude or limit any rights or remedies available to you under the Australian Consumer Law (ACL).

1. OUR LIFETIME WARRANTY

Michael Arthur Diamonds provides the original purchaser with a complimentary Lifetime Warranty against manufacturing defects in the workmanship or construction of Gold and Platinum jewellery manufactured or supplied by Michael Arthur Diamonds, subject to these Terms.

Where Michael Arthur Diamonds determines, following inspection, that a defect is covered by this Lifetime Warranty, we may, at our discretion:

  • repair the jewellery;
  • replace the defective component; or
  • where repair or replacement is not reasonably practicable, provide an appropriate alternative remedy.

Where a manufacturing defect is covered by this Lifetime Warranty, Michael Arthur Diamonds will carry out the covered repair or replacement at no labour charge.

This Lifetime Warranty commences from the date shown on the original invoice and continues for the lifetime of the jewellery, subject to these Terms.

2. WHO IS COVERED?

This Lifetime Warranty applies to the original purchaser of the jewellery purchased directly from Michael Arthur Diamonds.

Proof of purchase may be required.

Unless otherwise agreed in writing by Michael Arthur Diamonds, the Lifetime Warranty is not automatically transferable to another person following the sale, transfer or gifting of the jewellery.

Nothing in this section limits any rights that cannot lawfully be excluded under the Australian Consumer Law.

3. WHAT IS A MANUFACTURING DEFECT?

A manufacturing defect is a fault arising from the workmanship, construction or manufacturing process of the jewellery which existed when the jewellery was supplied and is not the result of ordinary wear, accidental damage, misuse, alteration or subsequent damage.

Examples may include:

  • manufacturing porosity or structural defects in the metal;
  • defective soldering or joining;
  • defective construction;
  • manufacturing faults in settings;
  • structural manufacturing faults;
  • a diamond or gemstone becoming loose where Michael Arthur Diamonds determines that the issue resulted from a manufacturing defect and there is no evidence of impact, damage, wear or misuse; and
  • other structural or workmanship defects determined by Michael Arthur Diamonds to have resulted from the manufacturing process.

These examples are illustrative only and do not mean that every issue of this nature will necessarily constitute a manufacturing defect.

4. NORMAL WEAR AND TEAR

Fine jewellery is subject to normal wear over time.

Normal wear and tear is not a manufacturing defect and is not covered by this Lifetime Warranty.

This includes, without limitation:

  • scratches;
  • dents;
  • abrasions;
  • worn metal;
  • thinning of bands;
  • worn claws or prongs;
  • worn settings;
  • surface marks;
  • general deterioration from normal use;
  • loss of metal through ordinary wear; and
  • changes to the appearance or finish of the jewellery resulting from normal use.

Precious metals are inherently malleable and will naturally change with use.

5. ACCIDENTAL DAMAGE AND IMPACT

The Lifetime Warranty does not cover damage resulting from:

  • impact;
  • dropping;
  • crushing;
  • bending;
  • catching or snagging;
  • sporting activities;
  • gym or physical activities;
  • manual work;
  • gardening;
  • occupational activities;
  • accidents;
  • misuse;
  • abuse;
  • negligence; or
  • other external force.

This includes damage to:

  • diamonds;
  • gemstones;
  • claws;
  • prongs;
  • settings;
  • bands;
  • chains;
  • clasps; and
  • other jewellery components.

Diamonds are extremely hard but are not indestructible. Diamonds and gemstones can chip, fracture or break if struck at certain angles or locations.

6. LOSS OF DIAMONDS OR GEMSTONES

The Lifetime Warranty does not cover the loss of a diamond or gemstone where Michael Arthur Diamonds determines that the loss resulted from:

  • accidental damage;
  • impact;
  • a damaged, bent or worn setting;
  • worn claws or prongs;
  • misuse;
  • negligence;
  • normal wear and tear; or
  • another circumstance occurring after the jewellery was supplied.

Where a diamond or gemstone is lost and the loss is not covered by this Lifetime Warranty, replacement of the stone will be quoted separately.

We strongly recommend obtaining appropriate specialist jewellery insurance covering accidental damage, loss and theft.

7. CHEMICALS AND ENVIRONMENTAL EXPOSURE

Damage caused by chemicals or environmental conditions is not covered by this Lifetime Warranty.

This includes damage resulting from exposure to:

  • chlorine;
  • swimming pools;
  • spas;
  • hot tubs;
  • bleach;
  • cleaning products;
  • solvents;
  • perfumes;
  • cosmetics;
  • hair products;
  • workplace chemicals;
  • corrosive substances; or
  • other chemicals capable of damaging jewellery.

Discolouration, surface deterioration, pitting or damage resulting from chemical exposure is not considered a manufacturing defect.

8. RHODIUM PLATING

White Gold jewellery may require periodic rhodium plating.

Rhodium plating is a surface finish and naturally wears through normal use.

The cost of future rhodium plating, re-plating or restoration due to normal wear is not covered by this Lifetime Warranty unless Michael Arthur Diamonds determines that the issue constitutes a manufacturing defect.

9. JEWELLERY CARE AND MAINTENANCE

We strongly recommend that jewellery be professionally inspected approximately every 12 months.

Regular inspection allows our jewellers to assess:

  • claws and settings;
  • stone security;
  • metal wear;
  • structural integrity;
  • loose stones;
  • general condition; and
  • areas requiring preventative maintenance.

Regular servicing is strongly recommended because jewellery can deteriorate through normal use.

Failure to undertake recommended servicing does not remove or limit any rights or remedies available under the Australian Consumer Law.

However, when assessing a claim under this voluntary Lifetime Warranty, Michael Arthur Diamonds may take into account the condition, maintenance history and circumstances of the jewellery when determining whether an issue is a manufacturing defect or damage arising from subsequent wear, misuse or other circumstances.

10. REPAIRS OR ALTERATIONS BY OTHER JEWELLERS

We recommend that all repairs, alterations, resizing, setting work and structural work be performed by Michael Arthur Diamonds.

Where jewellery has been:

  • altered;
  • repaired;
  • resized;
  • remodelled;
  • re-set;
  • polished;
  • soldered;
  • engraved in a manner affecting the structure; or
  • otherwise modified

by another jeweller or third party, Michael Arthur Diamonds may decline a claim under this voluntary Lifetime Warranty where that third-party work has caused, contributed to, or affected the issue being claimed.

For clarity, this does not mean that all statutory rights under the Australian Consumer Law automatically disappear because another jeweller has worked on the jewellery.

Nothing in this section excludes, restricts or modifies any right or remedy that cannot lawfully be excluded.

11. CUSTOMER-REQUESTED ALTERATIONS

Any alteration or modification requested after completion of the original jewellery may affect the original design, construction and warranty.

Where Michael Arthur Diamonds carries out an alteration or modification, we will explain any material effect on the Lifetime Warranty where reasonably practicable before the work is undertaken.

Where another jeweller or third party performs the work, Section 10 applies.

12. RESIZING

Ring resizing is considered an alteration to the jewellery.

Where Michael Arthur Diamonds performs resizing, we will take reasonable care to preserve the integrity of the jewellery.

Certain designs may have limitations regarding resizing due to:

  • stone settings;
  • pavé or micro-pavé;
  • eternity designs;
  • metal type;
  • engraving;
  • structural characteristics; or
  • other design considerations.

Resizing required because the Customer supplied an incorrect size or because the Customer’s finger size has changed is not a manufacturing defect and may incur a charge.

13. CUSTOMER-SUPPLIED DIAMONDS, GEMSTONES OR JEWELLERY

Where a Customer supplies a diamond, gemstone or jewellery item for incorporation, resetting, alteration or repair, the Customer acknowledges that pre-existing damage or structural weaknesses may not always be visible.

Diamonds and gemstones may be susceptible to damage during:

  • removal;
  • resetting;
  • resizing;
  • repair;
  • polishing; or
  • other jewellery work.

Where reasonably practicable, Michael Arthur Diamonds will advise the Customer of identified risks before proceeding.

14. WARRANTY ASSESSMENT

All claims under this Lifetime Warranty are subject to inspection and assessment by Michael Arthur Diamonds.

The purpose of the assessment is to determine whether the issue is:

  1. a manufacturing defect covered by this Lifetime Warranty;
  2. normal wear and tear;
  3. accidental damage;
  4. loss or theft;
  5. damage caused by misuse, chemicals or negligence;
  6. damage caused by subsequent alteration or repair; or
  7. another issue outside the scope of this voluntary Lifetime Warranty.

Michael Arthur Diamonds may require the jewellery to be physically inspected before determining whether a claim is covered.

Photographs or videos may assist with an initial assessment but do not replace physical inspection where Michael Arthur Diamonds reasonably considers an inspection necessary.

15. MAKING A WARRANTY CLAIM

To make a Lifetime Warranty claim, please contact:

Please provide:

  • proof of purchase or original invoice;
  • photographs or videos of the issue where available;
  • a description of the issue;
  • details of when and how the issue occurred; and
  • any other relevant information reasonably requested by our team.

Michael Arthur Diamonds may require the jewellery to be returned to our showroom or workshop for inspection.

16. SHIPPING AND ASSESSMENT DEPOSITS

Where a Customer is unable to attend our showroom and jewellery must be returned to Michael Arthur Diamonds for inspection:

Australian customers: a $50 AUD return-shipping deposit may be required.

International customers: a $250 AUD return-shipping deposit may be required.

The applicable deposit is held to cover reasonable shipping and handling costs associated with returning the jewellery for assessment.

If Michael Arthur Diamonds determines that the issue is covered by this Lifetime Warranty, the applicable shipping deposit will be refunded in full and Michael Arthur Diamonds will cover reasonable shipping costs associated with the covered warranty repair.

If the issue is determined not to be covered by this Lifetime Warranty, the applicable shipping deposit may be applied toward reasonable return shipping and handling costs.

Where additional repair or restoration work is requested or required outside this Lifetime Warranty, Michael Arthur Diamonds may provide a quotation before undertaking chargeable work.

Nothing in this section limits any rights or remedies available under the Australian Consumer Law.

17. REPAIRS OUTSIDE THE WARRANTY

Where an issue is not covered by this Lifetime Warranty, Michael Arthur Diamonds may provide a repair quotation.

No chargeable repair work will be undertaken without the Customer’s approval, except where otherwise agreed in writing.

Repair costs may include:

  • labour;
  • replacement diamonds or gemstones;
  • replacement metal;
  • claw or setting restoration;
  • rhodium plating;
  • polishing;
  • resizing;
  • remodelling;
  • third-party services;
  • shipping; and
  • other materials or services reasonably required to complete the repair.

18. INSURANCE

The Michael Arthur Diamonds Lifetime Warranty is not jewellery insurance.

The Lifetime Warranty does not provide cover for:

  • theft;
  • accidental loss;
  • disappearance;
  • accidental damage outside the scope of the manufacturing warranty;
  • damage caused by misuse;
  • loss of diamonds or gemstones where the loss is not caused by a manufacturing defect; or
  • consequential losses arising from these events.

We strongly recommend that Customers obtain appropriate specialist jewellery insurance immediately after taking possession of their jewellery.

19. PROOF OF PURCHASE

The Lifetime Warranty is subject to reasonable proof that the jewellery was purchased from Michael Arthur Diamonds.

The original invoice, receipt or other reasonable evidence of purchase may be requested when making a claim.

20. REPLACEMENT COMPONENTS

Where repair or replacement is required, Michael Arthur Diamonds may use components that are equivalent in quality and function where the original component, stone, material or design element is unavailable.

Where an identical replacement is not reasonably available, Michael Arthur Diamonds will seek to provide a reasonably equivalent alternative where appropriate.

21. NO CHANGE-OF-MIND WARRANTY

The Lifetime Warranty is a warranty against manufacturing defects.

It does not provide a lifetime change-of-mind, return or exchange right.

Change-of-mind returns, cancellations and exchanges are governed by the Michael Arthur Diamonds Refund, Exchange & Cancellation Policy.

Nothing in this section limits any rights or remedies available under the Australian Consumer Law.

22. AUSTRALIAN CONSUMER LAW

The Michael Arthur Diamonds Lifetime Warranty is provided in addition to your rights under the Australian Consumer Law.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, consumers may have rights to:

  • a repair;
  • replacement;
  • refund;
  • cancellation; and/or
  • compensation

where goods or services fail to meet applicable consumer guarantees.

The rights provided by the Australian Consumer Law are separate from and additional to this voluntary Lifetime Warranty.

Nothing in this Lifetime Warranty is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

23. MANDATORY AUSTRALIAN CONSUMER LAW NOTICE

GOODS

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

SERVICES

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

• to cancel your service contract with us; and

• to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

These statutory rights operate independently of this voluntary Lifetime Warranty.

24. RELATIONSHIP WITH OTHER MICHAEL ARTHUR DIAMONDS POLICIES

This Lifetime Warranty should be read together with:

  • the Michael Arthur Diamonds Terms & Conditions; and
  • the Michael Arthur Diamonds Refund, Exchange & Cancellation Policy.

If there is any inconsistency between this Lifetime Warranty and a mandatory right or remedy under the Australian Consumer Law, the Australian Consumer Law will prevail to the extent required by law.

25. SEVERABILITY

If any provision of this Lifetime Warranty is found to be invalid, unlawful or unenforceable, that provision will be read down to the minimum extent necessary or, where that is not possible, severed.

The remaining provisions will continue to operate to the maximum extent permitted by law.

26. GOVERNING LAW

This Lifetime Warranty is governed by the laws applicable in New South Wales, Australia.

Any dispute will be subject to the applicable jurisdiction of the courts of New South Wales, subject to any mandatory rights or protections available to the Customer under applicable law.
